Om deze tekst gaat het dus. Maar wie bepaald dat soort dingen? Ik denk het kabinet en niet Gommers.
Geen idee of de mogelijkheid bestaat om dit bij ec aan te vechten of dat ze gewoon kijken of het aan de regels voldoet.
Want vinden zij een toename van Corona besmettingen een ernstige voorziene situatie?

Zijn er ook gevallen bekend uit het verleden van afwijzingen?Uiteindelijk wordt door de EU bepaald of er voldoende noodzaak is voor een spoedprocedure. Hou alleen goed in je achterhoofd dat dit ook gewoon politiek is en we hebben gezien wat politiek aan spelletjes speelt. De Nederlandse overheid zal er alles aan doen om ze te overtuigen dat een spoedprocedure gegrond en noodzakelijk is.

I am a Dutch citizen looking for a point of contact within the EU to make them aware of the ongoing process to ban F2 fireworks in the Netherlands per December 15, 2020 on grounds related to the Corona virus. This decision seems to be political, rather than based upon grounds for national safety or health of the greater public and I am concerned about the way our Government is going to address the notification procedure. This is why I am writing to you.
I am not sure if I am contacting you rightfully, if not I hope you could point me in the right direction or forward my e-mail.
To understand why I am reaching out I'd like to describe to you the situation in a little more detail. Fireworks for the greater public are a point of discussion for a long time in the Netherlands. Earlier this year, a ban on F3 fireworks and F2 subcategories (rockets, bangers, banger batteries and shot tubes) was imposed to reduce injuries and prevent anti-social behaviour. This was notified to the EU under number 2020/274/NL (https://ec.europa.eu/growth/tools-d...h/?trisaction=search.detail&year=2020&num=274). The ban has been scheduled to go into effect per December 1st, 2020. However, Friday last the Dutch government suddenly announced they're imposing a ban on all F2 fireworks per December 15th, 2020. As you might understand, this is very short notice - supplies have been bought and distributed across stores and lots of containers are still underway.
The ban is deemed necessary because of the Corona virus: to relieve hospitals and Police forces. There has been much debate about this and it can simply not be the case: the import and sales of illegal fireworks will rise (ongoing, currently) and with the use of unclassified, dangerous fireworks so will hospitalisations. Overloading of the Police forces with complaints is expected. Looking at the numbers of last year's New Years Eve, some 1300 people got injured. 385 ended up in the emergency rooms, 42 had to be hospitalised for longer. When comparing these 384 victims to the amount of hospitals, this comes down to just over 2 patients per hospital. 30% of these injuries had been caused by the now banned F2 subcategories: rockets, bangers, banger batteries and shot tubes. Our healthcare sector, including Dr. D. Gommers, head of all Intensive Care units stated the ban on F2 fireworks will therefor not relieve the healthcare system any further and is therefore excessive. There is a strong feeling among citizens, fireworks retailers, and wholesalers this ban is politically motivated. Local Corona laws have been applied to be able to avoid having to go through normal, slow processes of altering the laws surrounding F2 fireworks, the Fireworks Decree. As a compensation, the fireworks industry is offered a one-time sum of eur. 40 million. When looking at hospitalisations, this is a little under a million per expected prevented victim when not taking into account the 30% expected reduction. This is not the sign of laws imposed to protect the health and safety of the greater public but a method of ridding fireworks quickly and at all costs.
Of course this change has to be notified in Brussels. That is why I am writing this e-mail. With the normal procedure, the stand-still of three months would push this ban well into 2021. However, the Government of the Netherlands is soon going to request an urgency procedure. This seems unfair, unfit and something that concerns me. With the urgency procedure, the stand-still would not apply and we (as a nation) would not only lose our long-celebrated tradition of lighting fireworks on New Years Eve but it would also mean a great loss of money for the industry, an issue of storing grossly 650 shipping containers of fireworks with all it's potential hazards and the circulation of more unclassified, illegal and dangerous fireworks.
I am not in the position to start court cases or appeal. I'm simply baffled by what has happened in a very short amount of time on grounds that seem invalid. That is why I am seeking to make this story heard and hope these decisions are treated at the EU level with the scrutiny it deserves.
