Sowieso benoemen dat Diederik Gommers op tv heeft aangegeven dat dit verbod weinig tot geen zin heeft,en dat hij zelfs denkt dat corona misbruikt word om vuurwerk af te schaffen.

Article I, Parts A, B and C, may contain technical regulations. Read in conjunction with Parts D, E and F, the possession, use and sale of designated fireworks of category F2 shall be restricted or prohibited during this turn of the year.

Part A removes the exception with regard to transport, thereby limiting the possession of fireworks by private individuals. Read in conjunction with Part D, this means that private individuals are not permitted to transport designated fireworks of category F2 until 2 January 2021.

Part B removes the days during which sales are permitted, thereby prohibiting the provision of fireworks to private individuals. Read in conjunction with Part E, this means that it is not permitted to sell designated fireworks of category F2 to private individuals during this turn of the year.

Part C removes the times for setting off fireworks, thereby prohibiting the lighting of fireworks by private individuals. Read in conjunction with Part F, this means that private individuals are not permitted to use designated fireworks of category F2 during this turn of the year.

In addition, with the removal of the days for selling fireworks and the times for setting off fireworks during this turn of the year, private individuals are not permitted to possess designated fireworks of category F2 except in a place that is not accessible to the public.

Due to the nature of the order, whereby the possession, use and sale of designated fireworks of category F2 is restricted or not permitted this turn of the year, the inclusion of a mutual recognition clause is not possible.


9. Brief Statement of Grounds
The ban applies to everyone other than those that possess specialised expertise and is therefore non-discriminatory.

The ban is necessary for three reasons.
Firstly, setting off fireworks at the turn of the year causes a great deal of serious injuries, thereby placing a further strain on healthcare facilities that are already overburdened due to the treatment of patients with the coronavirus, and making timely and adequate care impossible to guarantee.
Secondly, setting off fireworks at the turn of the year causes a considerable and serious nuisance, thereby placing a heavy burden on the services responsible for maintaining public order, and making the enforcement of coronavirus measures in public areas impossible to guarantee.
Thirdly, the possibility of setting off fireworks at the turn of the year gives rise to mass gatherings outdoors, thereby leading to large concentrations of people on the street who do not (or cannot) maintain the prescribed distance from each other, and allowing the COVID-19 virus to spread.

The ban is proportionate as it only concerns the upcoming turn of the year.

The overriding reasons of public interest underlying the ban are public policy, health and safety.

The ban is appropriate as it prevents or reduces injuries, public disturbances and concentrations of people on the streets, avoiding the placement of an additional burden on emergency services and healthcare facilities, making it easier to enforce coronavirus measures and preventing the spread of the SARS-CoV-2 virus.

The ban does not go beyond what is necessary as it does not apply to fireworks of categories F1, F3 and F4.

The ban on the possession, use and sale of designated fireworks of category F2 is currently the least restrictive means of preventing or reducing injuries, public disturbances and the spread of the SARS-CoV-2 virus. Less restrictive means that have been applied in the past to prevent injuries, such as requiring the supply of launch stands, safety goggles and fireworks fuses with the sale of fireworks, have led to an insufficient reduction in the number of injuries caused by the setting off of fireworks by the general public during the turn of the year.

The scale of the second wave of coronavirus infections represents a serious and unforeseen situation.
National measures are in place to combat the rapid spread of the coronavirus. Stricter measures for the partial lockdown, which in any case is to continue until 15 December, have been temporarily introduced. The situation in most of the country is classified as very serious (the highest of 4 levels); the situation in the rest of the country is serious (level 3). The number of COVID-19 reports is decreasing only slowly. On 18 November 2020, there were 4 628 people who tested positive, (in total) 117 905 people who were contagious, there were (on average) 149.3 hospital admissions and 29.7 intensive care admissions, and 1 528 hospital beds and 559 IC beds (53.4 %) were occupied by patients with COVID-19 (source: coronadashboard.rijksoverheid.nl, 19 November 2020). Healthcare facilities are overburdened. Regular healthcare procedures has been scaled down. Non-essential treatments have been postponed.

In light of this, the Dutch parliament has called on the government not to allow the public to set off fireworks during the upcoming turn of the year. This is a strong tradition in the Netherlands, where citizens take to the streets en masse on New Year’s Eve and at the time of the turn of the year in particular, setting off their own fireworks. These fireworks may only be purchased on the last three days of the year and may only be ignited on New Year’s Eve and in the early hours of New Year’s Day. In 2019, 77 million euro worth of fireworks were sold in the Netherlands. With a population of 17 million, this amounts to an average of almost 5 euro per person. In 2019, 385 victims required assistance at the 84 emergency medical stations in hospitals and 900 victims reported to 118 general practitioner surgeries. (source: Registration of fireworks accidents 2019-2020, VeiligheidNL) Due to this peak burden on healthcare facilities at a time when they are already overburdened with caring for patients with coronavirus, it is impossible to guarantee timely and adequate care. The Dutch Society of Emergency Medicine (NVSHA) and the Dutch Ophthalmic Society (NOG) have called for a fireworks ban this year. This was also advocated by the Safety Council [Veiligheidsberaad], the meeting of chairpersons of the safety regions in charge of public order and safety. According to the Safety Council, another reason for this action is that a fireworks ban would limit the number of contacts during the turn of the year, thereby preventing the spread of the SARS-CoV-2 virus.

Eigenlijk is een vervoersverbod heel merkwaardig. Heel veel mensen hebben nog vuurwerk liggen van vorig jaar en er zijn dan ook mensen die gewoon met dat vuurwerk naar Duitsland wil gaan, echter mag je het niet vervoeren. Wat krijg je dan, i.p.v. dat je deze mensen de gelegenheid geeft om het vuurwerk dat ze nog hebben liggen op een legale manier in Duitsland af te steken, laat je ze het vuurwerk alweer een jaar in huis liggen.

Wat betreft feiten met betrekking tot vuurwerk is een hele grote bron van informatie het ministerie van infrastructuur en waterstaat

In het artikel van de landelijke vuurwerkdag van 2019 is bijvoorbeeld vastgelegd: "Het hele jaar door zijn er daardoor duizenden inbeslagnemingen met duizenden kilogrammen vuurwerk". Dat is feitelijke informatie van het ministerie zelf. Hier moet ook meer dan genoeg informatie te vinden zijn welke gebruikt kan worden bij het indienen van een bezwaarschrift.

Er staan trouwens ook pdf's op waarin het transport van consumentenvuurwerk door particulieren in zijn vastgelegd en checklist pdf's om een vrijwaring te kunnen verkrijgen voor transport.

Er moet wel gezocht worden naar feitelijke informatie in een grote hoeveelheid documentatie die hier publiekelijk beschikbaar zijn gesteld ter ondersteuning van een (toekomstig) bezwaarschrift.

Ook de VROM heeft een (verouderd) document beschikbaar van 2009 waarin een themarapportage over vuurwerk is beschreven: Themarapportage vuurwerk.

H3.1 is in dit document een interessant hoofdstuk over toezicht en opsporing van illegaal vuurwerk.

In 2.2.5 Verkoop staat trouwens ook al vermeld dat de schatting van import van illegaal vuurwerk jaarlijks tussen de 1 à 2 miljoen kg vuurwerk betreft.

"Rond de jaarwisselingen van 2007/2008 en 2008/2009 werd langs legale weg voor 60 respectievelijk 65 miljoen euro aan consumen-tenvuurwerk verkocht.De omzet van de naar schatting 1 á 2 miljoen kilo verboden consumenten vuurwerk bedraagt naar schatting 5 á 10 miljoen euro. [31, 32]"

Als je die 5 tot 10 miljoen euro illegaal consumenten vuurwerk gaat delen op die 65 miljoen euro legaal consumenten vuurwerk betreft dan dat van het totaal aan vuurwerk in NL tussen de 7,5 en 15% aandeel in NL illegaal consumenten vuurwerk betreft. Hoeveel euro/ kg verboden professioneel vuurwerk betreft wordt niet beschreven of het is niet helemaal goed beschreven in deze paragraaf.

Ook extra benoemen dat men pas nog een motie voor meer bedden en personeel heeft verworpen! Juist die partijen die nu roepen dat alles dicht moet en veboden vanwege overbelasting zorg.

Benoemen dat de heer Gommers heeft aangegeven dat er niet extra bedden en personeel nodig was omdat men anders zich zou vervelen.

Aangeven dat er 40 miljoen belastinggeld weggegeven zal worden ter compensatie terwijl je met een fractie van dat geld ook meer capaciteit had kunnen inkopen op de laatste 3 dagen van het jaar.

Ook aangeven dat vanaf 1 december knallers, single shots en vuurpijlen is verboden, juist om het aantal gewonden te laten dalen en dat men de verwachtte cijfers niet hebben meegenomen in hun besluitvorming en met oude cijfers het verbod hebben willen rechtvaardigen.
 
Ik geloof dat ik vandaag ergens een belofte had gedaan om een opzet voor een e-mail in het engels te maken en dat maakt schuld, he? Dus hierbij.

Overigens, pas 'm aan naar de situatie die voor jou van toepassing is. Ik ben ook niet al te diep op de materie in gegaan, het moet voor iedereen in jip-en-janneke taal begrijpelijk zijn waar de zorgen zitten. Dear <Sir>, <Madam>, <member of The European Union>,

I am writing to you as a concerned Dutch national. Very recently, our government has decided the year-long and celebrated tradition of lighting fireworks on New Years Eve should be banned because of the Corona virus. This decision is set to go into effect by December the 15th, when the Notification Procedure that was triggered at the EU under notification number 2020/721/NL gets granted the 'Urgency Procedure'. I am deeply worried about the reasons supplied for the ban, the urgency procedure, the already visible effects of the imposing ban, the short term on which the decision was made and the fact that this ban seems to be in no ways related to the Corona virus. Please let me explain my worries.

For many years, the Dutch government is incrementally limiting the amount of fireworks available to the general public in order to make New Years Eve safer. The most recent effort only undertaken this spring, banning the use, sale and possession of F3 fireworks and F2 firework subcategories (rockets, bangers, banger batteries and shot tubes) that caused some 30% of injuries last passing of the year. These bans are set to go into effect per December 1st.

Now, suddenly and without regards to the actions undertaken this spring, the government is imposing a full ban on the sales, use and transportation of all F2 fireworks for members of the general public. The reasoning behind this ban: preventing further pressure on healthcare and police forces. The fireworks industry will be compensated with a one-off sum of eur. 40 million. This sounds plausible and noble but when looking a little deeper into the numbers I can assure you it is absolutely not and the ban seems to be more politically motivated.

Most recent numbers show 1300 people getting injured, nationwide on New Years Eve. <PERCENTAGE ILLEGAAL> of which is related to the use of illegal fireworks. In total, 385 people visited one of the 84 emergency wards. That is 4.5 person per emergency ward on average during the entire day. Most people got sent home quickly, however 42 needed to be hospitalised for longer - coming down to 0.5 persons per emergency ward. This also comes down to, when looking at hospitalisations and the compensation for the industry, at a sum of just under eur. 1 million per prevented victim. These calculations are not taking into account the expected 30% reduction by the ban of F2 subcategories set to go into effect per December 1st. These are simply not numbers putting more strain on our healthcare system, as confirmed by several officials and healthcare workers across the countries. The most notable being Diederik Gommers, head of all of our intensive care units, stating on national television that he thinks Corona is used to justify a ban on consumer fireworks. Currently we also see (rapidly) declining numbers of Corona infections and hospitalisations, which also lead to more relief and less strain on our entire healthcare system.

Very recently, our government has disagreed to make available more funds for our healthcare system. This money would have been used to create extra capacity. It seems strange that if there is no money available for more hospital capacity, a whopping eur. 40 million is available to compensate the fireworks industry.

Another motivation used both locally and in the Notification Procedure is to relieve police and enforcement personnel. The 'Veiligheidsberaad', consisting of a group of mayors of our largest cities and in charge of public order and safety, stated this. The president of this 'Veiligheidsberaad' as well as a large amount of mayors attending are, or already have, imposing local bans on fireworks. Again, a possiblr plausibel theory. In practice however we face an explosive growth in the import and use of illegal, professional or uncertified fireworks. The use of which has unfortunately proven to be deadly or capable of causing grave injury over the last few passings of the year. This will not relieve, but only put pressure on our healthcare system and police forces. For the last week, we have seen riots and abuse of these illegal fireworks in several neighbourhoods across the country, peacefully started by youths opposing the ban but quickly taken over by people meaning harm. Police forces of neighbouring provinces had to be called on scene to restore the public order. It is only November and I fear these situations will also arise on a much larger scale on New Years Eve. This is also in no way a relief for police forces but another massive strain in already busy and uncertain times. It is also remarkable that German police officials, when recently confronted with the same plans for a ban on fireworks immediately stated that it would cause more harm than do good. Hence, the German Government did not impose a ban on fireworks.

As you may see, the numbers and needs for a ban on consumer fireworks are non-existent in my opinion. I fear that the situation surrounding the Corona virus is being used to quickly execute a process that would otherwise have taken years. It feels unfair, not well thought out but most importantly very undemocratic. We cannot oppose in normal ways, because the Corona emergency laws are used to impose this ban.

I hope I have conveyed my worries. I also hope the EU recognises the political aspect to this ban, and disapproves the request for a 'Urgency Procedure' regarding the Notification.
